You Need An AI Content Authenticity Statement

🫢I was pretty shocked when I saw the "Content Authenticity" disclaimer at the top of Christopher Penn's 5k subscriber LinkedIn newsletter:

90% of this week’s newsletter was generated by me, the human. A good portion of the demo video shows generative AI results. Learn why this kind of disclosure is now legally required for anyone doing business in any capacity with the EU.

"The stones on this guy!" I thought to myself. Pretty bold to put it out there like that.

But then it quickly dawned on me how brilliant (and essential) this kind of disclosure is, especially if you are generating content, IP, etc.

My biggest takeaway from the article:

"By disclosing what is AI-made, you are also protecting what is NOT AI-made.

This also applies to freelancers and agencies you hire. Ensure they disclose any AI use so you don’t falsely claim copyright on AI-generated content.

So, to recap. Disclose the use of AI for three reasons.

1. It’s going to be legally required soon in many places.

2. It’s ethically the right thing to do.

3. It reiterates your copyright over the non-AI generated content you publish.

Disclosure and transparency can increase trust and can reduce risk, so if you haven’t already, start disclosing the use of AI in your content today."

When thinking about how content & marketing teams are integrating Gen AI production with owned or leased IP, it's imperative that this system includes human guardrails.

Not just for the typical "human-in-the-loop" refrain that we hear in terms of maintaining our oversight on AI generated work, but also from a pure position of IP ownership.

If you build the greatest AI content pipeline on earth that automatically spits out fantastic assets with zero human intervention, at least in the EU it's highly likely that those assets are not copyrightable and your competitors can replicate them verbatim if desired.

Food for thought! I'm going to start doing this with any content I produce involving the use of AI.

Makes me wonder about some of the high ticket AI commercials from orgs like Salesforce (Example: https://lnkd.in/gvHpW37H). I'm curious what aspects of this are and aren't protectable.
